Effective date: August 18, 2026 · Applies to all visits, bookings, and photo sessions at Ivy Road Farm.
1. Acceptance of These Terms
By booking a session, entering the property, or otherwise participating in any activity at Ivy Road Farm (the “Farm”), you (“Participant”) acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions in their entirety. If you do not agree, do not book a session or enter the property. A parent or legal guardian must accept these Terms on behalf of any minor participant.
UNDER TEXAS LAW (CHAPTER 75A, CIVIL PRACTICE AND REMEDIES CODE), AN AGRITOURISM ENTITY IS NOT LIABLE FOR ANY INJURY TO OR DEATH OF AN AGRITOURISM PARTICIPANT RESULTING FROM AN AGRITOURISM ACTIVITY.
Ivy Road Farm is an agritourism entity, and your session is an agritourism activity, within the meaning of Chapter 75A of the Texas Civil Practice and Remedies Code. This warning is also posted on the premises.
2. Assumption of Risk — Wildlife, Including Rattlesnakes
The Farm is a working, outdoor agricultural property in West Texas. Participant expressly acknowledges that the property is inhabited or frequented by wild animals and insects, including but not limited to venomous snakes such as rattlesnakes, as well as fire ants, bees, wasps, spiders, feral hogs, and other wildlife, and that encounters with such animals — including bites, stings, and envenomation — are an inherent, open, and obvious risk of visiting agricultural land that cannot be eliminated.
Additional inherent risks include, without limitation: uneven or unstable terrain; holes, ruts, and burrows; mud, standing water, and irrigation equipment; farm tools, fencing, and machinery; thorned or toxic vegetation; heat, sun exposure, and rapidly changing weather including lightning; and the acts or omissions of other participants.
PARTICIPANT KNOWINGLY AND VOLUNTARILY ASSUMES ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN. Participant's presence on the property is entirely of Participant's own choosing, and Participant is and remains one hundred percent (100%) responsible and accountable for Participant's own safety, conduct, supervision of minors and invitees, and decisions during the entirety of Participant's time on the property.
3. Release and Waiver of Liability
To the fullest extent permitted by Texas law, Participant, on behalf of Participant and Participant's heirs, assigns, and legal representatives, hereby RELEASES, WAIVES, AND FOREVER DISCHARGES Ivy Road Farm and its owners, family members, employees, and agents (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, or expenses (including attorneys' fees) arising out of or relating in any way to Participant's presence on or use of the property, including claims arising from wildlife encounters, snakebite, personal injury, death, or property damage, EVEN IF CAUSED BY THE ORDINARY NEGLIGENCE OF A RELEASED PARTY. Nothing in these Terms limits liability that cannot be waived under Texas law, including liability for gross negligence or intentional misconduct.
4. Indemnification
Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any claims brought by Participant's clients, subjects, guests, or invitees, or by any third party, arising out of Participant's session or Participant's acts or omissions on the property.

These Terms are governed by the laws of the State of Texas, with venue in Taylor County, Texas. If any provision is held unenforceable, the remainder shall continue in full force and effect. These Terms constitute the entire agreement between Participant and the Farm regarding property access and supersede any prior understandings. We may update these Terms at any time; the version posted at the time of your visit controls.
